Terms of Service

1. Acceptance of Terms

By accessing and using Smarter Surfing ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

Smarter Surfing provides:

• AI-powered surf video analysis and scoring
• Coach-student connection and feedback platform
• Video upload and storage services
• Progress tracking and performance insights

3. User Accounts

To use our services, you must:

• Be at least 13 years old
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Not share your account with others
• Notify us immediately of any unauthorized access

4. Usage Limits & Fair Use

To ensure fair access for all users, we implement the following limits:

• AI Analysis: 3 initial free analyses, then 24-hour cooldown between analyses
• Video Uploads (Surfers): Maximum 12 videos per day, up to 50MB each
• Video Uploads (Coaches): Up to 120MB per video
• Video Size for AI: Videos exceeding 3.5MB will be automatically compressed

These limits are subject to change and may vary based on subscription level.

5. Content Ownership & License

Your Content: You retain all ownership rights to videos and content you upload. By uploading, you grant us a limited license to:

• Store and process your videos for AI analysis
• Display your content to you and your assigned coach (if applicable)
• Use anonymized analysis data to improve our AI models

Platform Content: All AI-generated analyses, scores, and feedback are owned by Smarter Surfing but licensed to you for personal use.

6. Acceptable Use Policy

You agree NOT to:

• Upload content that infringes on others' intellectual property rights
• Upload inappropriate, offensive, or illegal content
• Attempt to circumvent usage limits or security measures
• Use the Platform for any automated or commercial scraping
• Impersonate others or provide false information
• Interfere with the proper functioning of the Platform

7. Coach-Student Relationships

For Surfers:

• You can request a coach through our platform
• Coach requests expire after 48 hours if not accepted
• You can only have one active coach at a time
• You can withdraw pending requests or deactivate coach relationships

For Coaches:

• Coaches must be approved by platform administrators
• Coaches can upload videos and provide analyses for their students only
• Coaches cannot access students' private AI analyses
• Professional conduct is expected at all times

8. AI Analysis Disclaimer

Our AI analysis is provided for educational and improvement purposes. While we strive for accuracy:

• AI scores are estimates and may not reflect all aspects of surf performance
• Analysis should be considered alongside professional coaching advice
• We do not guarantee specific improvement results
• AI models are continuously updated and may produce varying results

9. Data Deletion

You can delete your videos at any time. Deletion will permanently remove:

• The video file from our storage
• All associated analyses and annotations
• Coach feedback and screenshots (if applicable)

Note: Deleting videos does NOT restore your AI analysis quota or daily upload limit.

10. Payments & Subscriptions

If you purchase a subscription or paid service:

• All fees are in USD unless otherwise stated
• Subscriptions renew automatically unless canceled
• Refunds are handled on a case-by-case basis
• We may change pricing with 30 days notice to existing subscribers

11. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the platform or harass other users

You may close your account at any time by contacting us.

12. Limitation of Liability

Smarter Surfing is provided "as is" without warranties of any kind. We are not liable for:

• Any injuries sustained while surfing
• Inaccuracies in AI analysis or coach feedback
• Loss of data due to technical issues
• Interruptions in service availability

13. Changes to Terms

We may modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the new terms. Significant changes will be communicated via email or platform notification.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Smarter Surfing operates, without regard to its conflict of law provisions.
